The Texas Education Freedom Accounts (TEFA) program, launched in 2026, allows families to use public funds—potentially more than $10,000 per student—to pay for private school tuition or other education expenses. However, Muslim families and several Islamic schools have filed federal lawsuits alleging that the program effectively excludes Islamic institutions from participation.

According to the lawsuits, none of the state’s accredited Islamic schools have been approved to participate in the voucher program despite hundreds of other private schools receiving approval. Muslim advocacy groups strongly dispute these claims and argue that broad exclusions based on religious identity or associations undermine constitutional protections against religious discrimination.

Supporters of the lawsuits say the issue goes beyond a single education policy. For many families, the case represents a broader test of whether religious communities can participate equally in publicly available programs without facing barriers based on faith.
